Severity Appeal from Local Court
Appeals can be lodged against the severity of the sentence imposed in the Local Court. An appeal must be lodged within 28 days from the day of sentence. The sentencing process takes place all over again before a Judge in the District Court. Additional information may be supplied, including evidence being given by the appellant or another relevant witness. A severity appeal includes the situation where the appellant wants to get a section but missed out in the Local Court.
If the Judge is considering imposing a more severe sentence, a “Parker” direction will be given so that the appeal can be withdrawn if necessary.
