Toronto is a lakeside suburb within the city of Lake Macquarie, approximately 28 kilometres from Newcastle’s central business district.

What cases are heard in the Hunter Drug Court?

The Drug Court of NSW is a specialist court that sits at Parramatta, Sydney, and Toronto. Drug Courts hear specific criminal cases relating to offenders who have a drug dependency where their dependency is related to criminal offending. These cases are referred from the Local Court or the District Court to the Drug Court. The following information applies to Hunter Drug Court, as well as all other Drug Courts in New South Wales.

A case can only be referred to the Drug Court if the accused person:

  • Has indicated that they will plead guilty.
  • Will likely be sentenced to fulltime imprisonment.
  • Is dependent on the use of prohibited drugs.
  • Is over 18 years of age.
  • Lives in certain parts of NSW.
  • Is willing to participate in the Drug Court program.

Once a person is referred to the Drug Court, the Court will create a tailored program to assist that person to recover from their drug dependence. If the person accepts participation in this program, they will be given a suspended sentence and avoid jail.

The Drug Court cannot take a referral in the following circumstances:

  • If the offence involves violence or sexual misconduct.
  • If the person is suffering from a mental disorder that will limit their ability to participate in the program.

Drug Courts only hears a limited number of cases per week.
