Case Facts

Client was on a good behaviour bond pursuant to section 9 crimes (Sentencing procedure) Act for Mid Range Drink Driving. Client then detected speeding more than 40km over speed limit at Mid North Coast while driving from Sydney to Far North Coast with a reading in the High Range, above 0.150. In the Local Court, the Magistrate took into account the Guideline Judgement for High range drink driving which deals with police charges of high range, and the client was sentenced to 6 months imprisonment and disqualified for 3 year.  He lodged a severity appeal.

Case Result

On appeal in the District Court the client received a suspended sentence pursuant to section 12 Crimes (Sentencing Procedure) Act  and was disqualified from driving for 2 years and was eligible to receive and Interlock Driving Licence after 6 months.  the client was very relieved!!
