Case Facts:  Client was a taxi driver with allegations of assaulting a bus driver. Client also had three criminal charges on foot in the Local Court which he had not disclosed as he should have.

NSW Transport had canceled their authorisation to drive a taxi on the basis that our client was not a fit and proper person and was not of good repute.

A hearing date was set to hear the substantive matter however the client’s licence was suspended until that time.

Case Result: After filing an urgent stay application it was argued that pending the outcome of the hearing the client should be given authorisation to drive a taxi and be able to earn and living.

Stay application granted and the client was able to resume work pending the outcome of his substantive matter.
